1. About Controlled

Controlled is a digital wellbeing and device-management platform designed for families and organizations. It includes:

• Controlled Hub (Parents / Manager App)
• Controlled Device / TV Apps installed on managed devices
• Controlled Website (https://controlled.app)

Controlled is built with transparency, consent, and user control at its core.

2. Eligibility & Account Creation

• You must be 18 years or older to create a Controlled Hub account.
• Children cannot create accounts directly.
• Parents, legal guardians, or authorized managers are responsible for linking devices, granting permissions, and managing settings and restrictions.

You confirm that all information you provide is accurate and up to date.

3. User Responsibilities

By using Controlled, you agree that you will:

• Use the Service only for lawful purposes.
• Obtain proper consent before installing Controlled on any device.
• Not use Controlled for surveillance without consent, spying, stalking, or harassment.
• Keep your login credentials secure.

You are responsible for all activity performed through your account.

4. Parental & Managerial Consent

Controlled requires explicit consent for monitoring and data collection on managed devices.

By linking a device, you confirm that:

• You are the parent, legal guardian, or authorized manager.
• You have informed the device user (child or employee, where applicable).
• You have the legal right to manage the device.

Misuse of the Service may result in account suspension or termination.

5. Permitted Use & Restrictions

You may not:

• Reverse-engineer, modify, or exploit the Service.
• Bypass security or permission systems.
• Interfere with servers or networks.
• Use Controlled in violation of local, national, or international laws.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Data Collection & Privacy

Your use of Controlled is governed by our Privacy Policy, which explains what data we collect, why we collect it, how long we retain it, and how you can delete or export it.

By using Controlled, you acknowledge that you have read and understood our Privacy Policy.

7. Data Accuracy & Availability

We strive to provide accurate and reliable data, but:

• Device data depends on permissions, OS limitations, and connectivity.
• Real-time data may be delayed or unavailable.
• Certain features may vary by device, OS, or region.

Controlled does not guarantee uninterrupted or error-free service.

8. Subscription, Billing & Payments

Some features may require a paid subscription.

• Payments may be processed via Google Play, Apple App Store, or Stripe.
• Billing terms are governed by the respective platform/provider.
• We do not store card or payment details.

Refunds, cancellations, and renewals are subject to platform/provider policies.

9. Intellectual Property

All software, designs, trademarks, logos, and content related to Controlled are owned by Cubentra Technologies Private Limited.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or authorized business use.

You may not copy, distribute, or resell any part of the Service.

10. Service Availability & Modifications

We may:

• Add, modify, or remove features.
• Update the Service for security or performance.
• Temporarily suspend access for maintenance.

We will make reasonable efforts to notify users of major changes.

11. Account Suspension & Termination

We may suspend or terminate your account if:

• These Terms are violated.
• The Service is misused.
• Required legal compliance demands it.

You may delete your account anytime from app settings or by contacting support.

12. Disclaimer of Warranties

Controlled is provided “as is” and “as available.”

We do not guarantee that the Service will meet all expectations, provide continuous or uninterrupted access, or provide absolute accuracy of device data.

Use of the Service is at your own discretion and responsibility.

13. Limitation of Liability

To the maximum extent permitted by law, Cubentra Technologies Private Limited shall not be liable for indirect or consequential damages, loss of data due to device or OS restrictions, or unauthorized access caused by user negligence.

Our total liability shall not exceed the amount paid by you (if any) in the preceding 12 months.

14. Compliance with Indian Law (DPDP Act, 2023)

We act as a Data Fiduciary under India’s Digital Personal Data Protection Act, 2023. You have rights to access your data, correct inaccuracies, withdraw consent, and request deletion. Details are provided in our Privacy Policy.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan.

16. Changes to These Terms

We may update these Terms as our Service evolves. Significant changes will be notified via in-app notice, website update, or email (where applicable).

Continued use after changes constitutes acceptance of the updated Terms.
